Your letter of 9 March 1989 addressed to the Prime Minister has been referred to this Office, with enclosures, for consideration and reply.
I write on behalf of the Lord Chancellor, who has Ministerial responsibility for the Office of Care and Protection and for the Official Solicitor's Office to confirm that the affairs of your brother, the above-named patient, are governed by the provisions of the Mental Health (Northern Ireland) Order 1986. As the case is a matter within the juriscdiction of the High Court you have been consistently advised that you, or any other interested person, may apply to the Court for a review of any aspect of the case.
It is not appropriate for Ministers or departmental officials to intervene in any case which is still before the Court. The other matters to which you have referred, relating to the claim brought by your sister Mrs Hamilton against the Patient, will be resolved in due course upon the hearing of her action in the Chancery Court.
